1. Introduction and Acceptance
Welcome to FiftyFifty (the “App”) and fiftyfifty-app.com (the “Website”), together referred to as the “Service.” The Service is developed and operated by the individual publisher of the application ("we", "us", or "our"). Information about the publisher can be found in the Legal Notices page.
FiftyFifty is currently developed and maintained by an individual as an independent project. Although the Service is currently provided free of charge, these Terms remain legally binding for all users.
These General Conditions of Use (the “Terms”) govern your access to and use of the Service, whether through the App or the Website.
By downloading, installing, accessing, or using the App, or by browsing or using the Website, you acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you do not accept these Terms, you must not use the Service.
We reserve the right to update or modify these Terms at any time. Any changes will take effect upon publication in the App and/or on the Website. Continued use of the Service after such changes constitutes your acceptance of the revised Terms.
It is your responsibility to review the Terms regularly to remain informed of any updates
2. Definitions
In these Terms, unless the context requires otherwise, the following terms have the meanings set out below:
- App means the FiftyFifty mobile application made available to users on supported devices.
- Website means the website fiftyfifty-app.com accessible via web browsers.
- Service means collectively the App and the Website, including all features, content, and functionalities provided therein.
- User or you means any individual or entity accessing or using the Service.
- Content means any text, images, videos, audio, software, or other materials provided through or by the Service.
- Personal Data means any information relating to an identified or identifiable natural person as defined by applicable data protection laws.
- Terms means these General Conditions of Use, including any amendments or updates.
3. Access Conditions
By accessing or using the Service, you confirm that you meet the following conditions:
- Age Requirement: You must be at least 16 years old to use the Service. If you are under 16, you are not permitted to provide us with any personal information. If you believe we have collected personal data from someone under 16, please contact us immediately to request deletion of such information.
- Jurisdictional Restrictions: You may not use the Service if the laws of your jurisdiction prohibit you from receiving the services we offer, or if we have previously banned your account.
- Accuracy of Information: As a user, you must provide accurate and truthful data to the Service and any associated group accounts. You are responsible for regularly verifying the information that concerns you.
- Sharing of Serious Offences: If we receive information indicating a serious offence, we may share this information with relevant authorities. You acknowledge and accept this possibility.
- Limitation of Liability: We are not responsible for the accuracy or precision of the data entered by you or other users (such as expenses or participant names in group accounts). The Service is intended as a consensus tool to facilitate calculations among users and should not be considered a definitive record of expenses. We do not act as an arbitrator within your group and cannot be held liable for inaccuracies in shared data.
- Use and Availability: Under no circumstances shall we be held responsible for any direct or indirect damages resulting from improper or illegal use of the Service, inaccurate data, erroneous results provided by the Service, or temporary/permanent unavailability of the Service due to technical failures or other causes.
4. User Account Responsibilities
When using the Service, you may be required to create an account. You agree to comply with the following responsibilities in relation to your user account:
- Account Accuracy: You must provide accurate, complete, and up-to-date information when creating your account and keep this information updated at all times.
- Security: You are responsible for maintaining the security of your account and any authentication methods you use (including one-time verification codes and third-party sign-in providers) and for all activities that occur under your account. You must notify us immediately if you suspect any unauthorized access or use of your account.
- Personal Use: Your account is personal to you and must not be shared, sold, or transferred to another person or entity without our prior written consent.
- Prohibited Behavior: You agree not to use the Service in any way that is illegal, abusive, harmful, misleading, or that interferes with the proper functioning of the Service or violates the rights of others.
- Account Suspension or Termination: We reserve the right to suspend or permanently disable your account if we suspect any breach of these Terms, fraudulent activity, or misuse of the Service.
5. App Use Rules & Restrictions
By using the Service, you agree to comply with the following rules and restrictions. Failure to do so may result in suspension or termination of your access to the Service:
- Lawful Use Only: You must use the Service only for lawful purposes and in accordance with these Terms.
- No Unauthorized Access: You may not access or attempt to access the accounts or data of other users, or bypass or breach any security or authentication measures.
- No Harmful Content: You may not upload, transmit, or share any content that is illegal, offensive, defamatory, threatening, harassing, obscene, or otherwise objectionable.
- No Reverse Engineering: You may not reverse engineer, decompile, or disassemble any part of the App or Website, or attempt to derive the source code of the Service.
- No Automated Access: You may not use bots, scrapers, or other automated systems to access the Service without our prior written permission.
- No Commercial Exploitation: You may not copy, sell, resell, or exploit any portion of the Service for commercial purposes without express authorization.
- No Interference: You may not interfere with or disrupt the operation of the Service, including servers or networks connected to the Service.
- Respect for Others: You agree to treat other users respectfully and not to engage in abusive, discriminatory, or otherwise inappropriate behavior through the Service.
6. Intellectual Property Rights
All content and materials included in the Service, including but not limited to the App, Website, design, text, graphics, logos, icons, images, audio clips, software, and source code, are the property of the Publisher or its licensors and are protected by applicable intellectual property laws, including copyright, trademark, and patent laws.
- Ownership: We retain all rights, title, and interest in and to the Service and all associated content, features, and functionalities. Nothing in these Terms grants you ownership or any intellectual property rights in the Service or its content.
- Limited License: We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your personal, non-commercial use only, in accordance with these Terms.
- Restrictions: You may not reproduce, distribute, modify, display, publicly perform, republish, download, store, transmit, or create derivative works of any part of the Service without our prior written permission, except as explicitly allowed by law.
- Trademarks: The name "FiftyFifty", its logo, icons, and visual identity are the property of the Publisher. Any unauthorized use is prohibited. All other trademarks remain the property of their respective owners. You may not use them without prior written authorization. All other trademarks, service marks, and logos used in the Service are the property of their respective owners.
7. User-Generated Content Rules
The Service allows users to submit, store, and share content such as expense titles, amounts, dates, locations, and other related information ("User Content"). By using the Service and submitting any such content, you agree to the following rules:
- Responsibility: You are solely responsible for the accuracy, legality, and appropriateness of all User Content you submit. You should ensure that all information — including expenses, participants, dates, and locations — is truthful and relevant to the trip or group activity.
- Consent for Sharing: When you share expenses or data with other users , you confirm that you have the right to do so and that the information is not confidential or sensitive without proper consent.
- Prohibited Content: You must not submit or share any content that:
- Is false, misleading, or intended to deceive
- Contains inappropriate, offensive, or illegal material
- Violates the privacy or rights of others, including sharing personal data without permission
- Includes spam, malware, or harmful software
- License Grant: By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and process your content solely to provide and improve the Service. We do not claim ownership over your content.
- Moderation and Removal: We reserve the right to remove or restrict access any User Content that violates these rules or applicable laws, or that we deem inappropriate, without prior notice.
- Reporting Misuse: If you believe someone is misusing the Service or violating your rights, please contact us at support@fifty-fifty.app so we can investigate and take appropriate action.
8. Privacy and Data Protection
Use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Service, you agree to the terms of our Privacy Policy.
9. Disclaimers and Liability Limitations
The Service is provided on an "as is" and "as available" basis. We make no warranties or guarantees of any kind, express or implied, regarding the availability, accuracy, reliability, or suitability of the Service for any purpose.
- No Financial or Legal Advice: The Service is intended for informational and organizational purposes only. It does not constitute financial, legal, or accounting advice. Users are solely responsible for verifying the accuracy of all data entered and shared.
- User Responsibility: We are not responsible for the accuracy of expense information, participant names, amounts, or any other data entered by users. You are fully responsible for the information you input and share, and for resolving any disputes with other users independently.
- Calculation Tools: Any results or balances provided by the Service are estimates based on the data you enter. We do not guarantee the correctness of any output and are not liable for any errors or omissions in calculations.
- No Arbitration Role: We are not a party to any financial agreements between users and will not act as a mediator or arbitrator in case of disputes.
- Limitation of Liability: To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of, or inability to use, the Service. Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
- Service Interruptions: We do not guarantee uninterrupted or error-free access to the Service. Temporary interruptions may occur due to maintenance, updates, or technical issues.
10. Termination of Access
We reserve the right, at our sole discretion, to suspend or terminate your access to all or part of the Service at any time and for any reason, without prior notice or liability, including but not limited to the following:
- Violation of these Terms of Use
- Illegal, abusive, or fraudulent activity
- Behavior that harms or threatens the safety or integrity of the Service, other users, or third parties
- Inactivity or non-use over an extended period
You have the right to request deletion of your account and associated personal data at any time. To do so, please contact us at [Insert Contact Email]. We will process such requests in accordance with applicable data protection laws and our Privacy Policy.
Upon termination (whether initiated by you or us), your right to use the Service will immediately cease. We may, but are not obligated to, retain certain data as required by law or for legitimate business purposes, as outlined in our Privacy Policy.
We are not liable to you or any third party for any suspension or termination of your access to the Service.
If you request deletion of your account, your personal profile and associated data will be deleted in accordance with our Privacy Policy. However, please note that any shared FiftyFifty (“Accounts”) you created or participated in are collaborative and may include other users. These shared Accounts will not be automatically deleted upon your departure, as they remain accessible to other participants.
Shared Accounts will only be permanently deleted when they are no longer accessible by any user. Specifically, if all participants of a shared Account have deleted their profiles, and the Account has not been accessed via shared link for a continuous period of 12 months, it will then be permanently removed from our systems.
11. Governing Law and Jurisdiction
These Terms of Use shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law principles.
Any dispute shall be submitted to the competent courts of France, unless otherwise required by applicable consumer protection laws.
12. Modification of Terms
We reserve the right to modify or update these Terms of Use at any time, at our sole discretion. When we do so, we will revise the "Last Updated" date at the top of this document and may notify users through the app, website, or by email where appropriate.
Your continued use of the Service after any such modifications constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the Service and may request deletion of your account.
We encourage you to review the Terms periodically to stay informed of any changes.
